In Brazil, artisanal cosmetics, perfumes, and personal hygiene products will soon be exempt from registration with the National Health Surveillance Agency (Anvisa), as established by Law 15,154. The law was enacted by President Luiz Inácio Lula da Silva and published in the Diário Oficial da União on Tuesday, July 1.
This move is the result of a bill (PL) 281/2022, originally presented to the Federal Senate (PLS) 331/2016 by former Senator Cidinho Santos (MT).
The new legislation aims to facilitate the production and marketing of items such as soaps, creams, deodorants, and perfumes manufactured by small producers, particularly individual entrepreneurs.
Law 15,154 provides that the definition of artisanal production of cosmetics, perfumes, and personal hygiene products will be established through specific regulations.
While the new law does not eliminate sanitary controls, it exempts these products from prior registration before the Anvisa, provided they comply with the requirements set forth in the forthcoming regulations.
The new legislation will come into force 60 days after its publication, i.e. on August 30.
